FOX NEWS - 8 Februrary 2010: Megyn Kelly pulls out the right-wing talking point 'tort reform' to try and stump Rep. Dennis Kucinich while discussing the state of health care reform. It doesn't work.

genuinely harmed or killed by medical negligence/incompetence, which happens far more frequently than you'd ever like to believe. My lifelong best friend died last year as a direct result of a horrible case of medical negligence that was then compounded by more negligence; she suffered terribly for nearly a year before finally succumbing. Fortunately, she lived in a state that, while some "reform" had been enacted, still is fairly reasonable in its rules regarding the filing of medical malpractice cases. The state requires that a licensed, experienced physician review the medical records and sign an affidavit to the effect that they'd reviewed the records and that the treating physician was negligent and such negligence caused such-and-such injury and harm, or, in my friend's case, death. But that's okay, because that's as it should be and her case was more than strong enough; two doctors had no trouble preparing and signing that affidavit for her family's lawsuit.

The suit was settled because the other side knew it really didn't have much defense and one of the physicians involved gave up her license. That's just fine with me, too, because she took away a still-young, vital, wonderful person whom we all still love and miss terribly, and it was a totally inexcusable negligence. It's beyond infuriating and saddening to know that the ONLY reason she's gone, and that she suffered terribly beforehand, is because of the grossly inexcusable negligence of two doctors. Had she lived in Texas or a state with similar "reform", there would hardly have been any recourse.

The vast majority of medical malpractice cases are NOT "frivolous", or "junk." Because it costs tens of thousands of dollars, if not more (and often more) for attorneys to prepare such cases, they will NOT take cases that are not with solid merit. And what really infuriates me is that you almost never hear doctors talking about accountability for the negligence of their members that causes grievous harm or death, or their responsibility for such patients and what can be done for them. No, all you hear from most is their whining about money for malpractice insurance and the fact that they're even held accountable at all. They've done a great scare job in making people think that most suits are frivolous, that patients want something for nothing or it's all the patient's fault, and that they almost never make mistakes and shouldn't be held accountable and if they are, then they'll just take their toys and move to another state.

Any FOX Bot knows that capping settlements for malpractice claims while not capping premiums for malpractice insurance is all ya need to know by golly to reform health care in Amurika. And if you're male, nobody is better than FOX at delivering the message via "someone I'd like to fuck" (SILF), derived from the Sara Palin acronym: MILF.

There is so much more that makes a woman desirable than physical attributes (a brain and the ability to string together coherent sentences is pretty much a pre-req!); and in all seriousness, the "naughty-librarian" thing - a la The Great White Dope, or the I am an obvious slut - a la the rest of the Faux propaganda readers, is really not that sexy in the first place!

but the PR image makers and narrative spinners don't use physically attractive women to deliver their memes and messages to men for nothing. Did you happen to watch the Super Bowl? The locus of sexuality is not in the cerebral cortex. Sister Sara, isn't where she is because of the intellectual attributes you (and I) find attractive in women.

Fox is not a news program?

Listen vb, can I call you vb, Fox isn't a program, it's a network. Despite what you may think a lot of people think it is a good place to get news. Look at a recent poll discussed on an interview between O-Liely and DS's Jon Stewart. Did you see that entire unedited interview posted here a few days ago? If you did, why didn't you chime in and make idiotic fun of Stewart for appearing on Fox, you know with the name calling and fool stuff? I want people who have courage, to talk to Republicans and have opportunity to infect them with our ideas. News outlets even a fraud like Fox allow sharing of some of our ideas. Maybe you heard Obama talking to elected Republicans that have no intentions of giving an inch. Is it ok if I belittle the President's name, your post made me think of a possible one that I think would raise some ire and call him a fool too, you know, for the cherry on top?

A good progressive doesn't deserve to be attacked here on DU. While a Dem Leader on the other hand that got where he is by appearing on the surface to be populist, well, I say he deserves next to all the pressure we can put on him.

And it takes some nerve for someone who seems to love Chris Matthews to mock a Congressman many here admire. It really does. I would add anyone that goes on to Hardball might expect to be treated like a sex doll or like only insider opinions matter. He is one of the more embarrassing self described liberals out there, so congratulations on showing some real irony. I award you Irony +1, no small feat.

Does Stewart take them seriously? Every time I've seen him in the past on O'Rielly's show and this wouldn't be the first time, he's mocking the guy or they spend their time mocking each other while using high vocabulary.

As in regards to Kuchinich---yeah it does makes ense. Kucinich is pushing this meme of kill the bill as the Repubs are. Sure he may have his reasons (which I don't agree with) considering I'm one of the many that would lose out if this bill is delayed so much. But he's going on a network that is also pushing violence against the President. This is the reason----sure it could be a news network---I don't care. Excluding at times Shep Smith and one or two others---the rest of them have an a typical talking point and Kucinich is pushing that along.

But then again...Kucinich fits right in on that network since many times he's voted against things that would be beneficial. I completely respect to your convictions, but a compromise would be good. However, he's more of an all or nothing which gets nothing done.

I know I need to be tougher, but damn, my feelings were hurt when I saw what you wrote. I know it is a weakness and that I shouldn't even expose it but there it is, out there.

I really am damn sorry you are being held hostage by this country's bassackward health policies. I have been bugging the hell out of my reps since the debate started and before. My rep signed onto Conyer's universal health care bill. My one Senator helped pass a bill out of the Health, Education, Labor, and Pensions Committee. My other Senator took FOREVER to commit to a public option and is on the horrible Finance Committee. My President cut deals with PhRMA and Big Insurers and tried to make us swallow them, not good enough by a damn long shot. Until that health care bill is signed I say pressure the party maximumly even if fighting the current offering.

It's not just Fox News spouting and threatening the President. You might as well say Kucinich shouldn't speak in the Congress because there are members there encouraging violence.

I understand the Obama admin freezing out Fox News. Just so you know, Fox News is not the only news and journalists that get the cold shoulder and poor treatment from this President's admin. Some of the poor treatment is even undeserved. The one journalist that is on Thom Hartmann's show all the time has talked about the WH treatment of reporters.

I don't think Kucinich is all or nothing. I think he places principles first. If his vote came down to a bill passing or not, you must know he would side with the needs of the people. I don't know if that has ever been tested, but I do know how my faux blue dog state reps think and handle their votes. People mock Nader for a host of reasons that are even unfair but one that sticks is that he chose not to come on board to help make change from within. Well, Kucinich does that and he talks truth to power. What more can anyone ask for. Is there really no room for people who don't treat politics like it is only compromise. Our leadership compromises on compromises. I want a little more Kucinich in my government.

This is my problem. When it comes to bipartisan work I have no problems with people trying to work with the stupid right. But Kucinich knows very well that Fox is not a news program, not one that is looking for the truth. He's going on the show and basicaly helping them along with their propoganda methods. This is why the White House has even put a freeze on those idiots. They're not worth talking too because theyare promoting violence,hate, and a number of issues. I don't even see a sort of battle of opinion---he stresses his own and she stresses another and in the end, they both share one view...kill the bill. It doesn't aid discussion but forestalls it and then people wonder why Obama ca't get shit done.

Just Pres. Obama was the next best option with a shot. You can't get more tort reformed than single payer as there is little reason to sue at that point to cover medical bills. Even the newcaster lost her bravado when she figured he had nothing but the stone cold truth and th answer to all our woes.

He did not make it clear that it is the malpractice insurance companies that need to be required to lower their rates when tort reform is enacted. As it is, there is no assurance that malpractice insurance companies will lower their rates if tort reform is enacted.

I once attended a seminar or roundtable that included a session on tort reform. The representative of the insurance company stated that the premiums of the company were dependent on the company's revenues -- which were not so much related to the amounts of the settlements and damages to the doctors as on the amounts of profit that the insurance company could make on its investments.

So what goes on Wall-Street-wise may have more to do with how much insurance companies charge doctors on the whole than how much the insurance company pays out in damages and settlements.

Of course, if a specific doctor has huge claims against him, that doctor's premiums may rise. But on the whole the premiums are based on how much the insurance company has in reserves and gets from investments not just on how large the settlements and damages are.

Bring in Medicare for all of single payer, and many of the malpractice lawsuits will never be brought. It is generally the future and past medical damages that drive these kinds of cases. That is also true in a lot of personal injury cases.

Tort reform from the mouths of Republicans means removing any ability to sue for grievances whatsoever.
No matter how bad the (employer/hospital/corporation/etc) screws up, you won't be able to sue over it.

I had a work-comp injury in 2002. Two surgeries later I can still barely walk when I get up in the morning. I'm only partially permanently disabled. I just lost my 3rd and last SSD appeal because I've been working as a teacher for the community college.
One of my last go-rounds with the people who paid for my Long and Short term disability policy,who were also seemed to be in bed with the Work comp people,sent me to a 'Doctor' who twisted and pulled on me and said "NO" to all my complaints of pain and limitation.
My attorney told me he'd had numerous run-ins at court with this guy and that this Dr. had been instrumental in setting Idaho's tort claims at $250,000.00, no matter who or how injured a Dr.might have left a patient.
So all in all for these 'State's rights' legislators we seem to have at the Federal level, why are they wanting to pass Federal legislation, when I know for a fact it can and is done at a State level.

Also I wrote a complaint to the medical board about how I was treated and that this 'doctor' who was representing the insurance company because he'd been paid 1500.00 for a half hours proclamation that I was a fraud, liar, cheat, fake, rotten person, who didn't even deserve the pain pills it would take to commit suicide.

Of course I'll never be able to get health insurance again. I pay about $300.00 a month for the meds it takes me to be able to stand up to work. I just had my hours cut to 8 a week after being told I'd be cut to 20 so I wouldn't be eligible for any health insurance. Enough. Sorry for whining.
